Official Rules


1. Creative Assignment: All you have to do is make a video of yourself playing an original or public domain tune on the ukulele. In can be in any style. It can be sung in any language or be purely instrumental, long or short, edited or live, serious or funny, solo or featuring other instruments and/or musicians. The important thing is to showcase your talent and enthusiasm for the music.
Only one entry is allowed per person, and it must be a video created specifically for the competition and not previously published, so please say: "My name is [your name] from [your main country of residence], and this is my entry to Bosko & Honey's Join-the-Safari Contest" at some point in the video.
2. Eligibility: You must be 18 years or older to enter this contest and be able to obtain a passport and visa to travel to Australia.

3. Agreement to Official Rules: Participation in the Contest constitutes a participant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Organizer, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein.

4. TO ENTER: Create an original video of your original musical composition or cover of a musical composition which falls within public domain and does not infringe upon the rights of a copyright holder. Only one video entry is allowed per entrant. To enter your video in the Contest, complete the following process between 12:01 am on Thursday the 10th of September, 2009 and 11:59:59 pm on Sunday the 18th of October, 2009, EST Australia ("Contest Entry Period"):

If you are not an existing user of YouTube, you will be required to create a free user account at . Registration on YouTube must be completed before a video can be submitted. When you register your YouTube account, you will be required to agree to the YouTube Terms of Use, located at , and the YouTube Privacy Policy, located at .

Upload and register your Video Submission

  • (a) Once registered with YouTube, click "Upload Videos" and follow the instructions to upload your final, edited video (your "Submission").
  • (b) Include the 2 following tags in the “tag field” of your video: jointhesafari, boskohoney
  • (c) Subscribe to Bosko & Honey's YouTube channel, located at:
  • (d) Complete and submit the Contest "Register Your Entry" form and truthfully provide the required information to be officially entered in the Contest and be eligible for a prize.
  • (e) IMPORTANT: Be sure to save your Submission in the original format after uploading it toYouTube. If you are a winner, you may need to provide Organizer with your Submission in its original format in order for the Submission to be valid.

5. SELECTION OF WINNER: Shortly after the Contest Entry Period has ended, public voting will commence and will determine a short-list of all entries. This group of entries will then be judged by the Ukulele Safari Australia Crew (Bosko & Honey, Gensblue and Yalego) and Contest sponsors: DaSilva Ukulele Co. and Kiwaya Japan. The winner will be chosen from 3 finalists by judges appointed by the Organizer. The winners will be revealed on the Ukulele Safari website on or about Monday the 9th of November, 2009. If the winner is unable to accept the prize and travel to Australia to attend the Melbourne Ukulele Festival, then the Organizer, at its sole discretion, may award the prize to another contestant.
6. PRIZES: The prize is a roundtrip ticket including taxes and basic fees (excluding extra fees such as baggage charges, local airport taxes collected at time of check-in etc.) to Melbourne, Australia from the winner’s nearest major international airport (from which reasonably direct flights to Melbourne, Australia can be obtained); and free entry to all events associated with the Inaugural Melbourne Ukulele Festival. The dates of the trip are limited as they must coincide with the dates of the Melbourne Ukulele Festival. If the winner is unable to travel to Australia on the designated dates, then he or she must forfeit the prize. No cash equivalent prize will be made, and the prize is non-transferrable. Accommodation, insurance, liability and all other costs and expenses associated with the trip are the responsibility of the winner. The videos will be aired on the Ukulele Safari website, subject to the Organizers’ right, in his sole discretion, to edit the videos to comply with network guidelines, or for any other reason. The total prize value estimate is AU$2,500.

9. Contest Terms of Submission: As conditions of entry into this Contest, and by uploading a Submission, each Entrant: WARRANTS AND REPRESENTS THAT THE ENTRANT OWNS ALL RIGHTS TO THE SUBMISSION HE/SHE IS ENTERING IN THIS CONTEST, INCLUDING, WITHOUT LIMITATION, THE VIDEO OR DIGITAL RECORDING, AND THE PERFORMANCE CONTAINED IN EACH SUBMISSION; WARRANTS AND REPRESENTS THAT THE ENTRANT IS THE INDIVIDUAL(S) PICTURED AND HEARD IN THE SUBMISSION, OR, ALTERNATIVELY, THAT THE ENTRANT HAS OBTAINED WRITTEN PERMISSION FROM EACH PERSON WHO APPEARS IN THE AUDIO OR VIDEO OF THE SUBMISSION TO GRANT THE RIGHTS TO THE ORGANIZER DESCRIBED IN THESE RULES, AND CAN MAKE WRITTEN COPIES OF SUCH PERMISSIONS AVAILABLE TO THE ORGANIZER UPON REQUEST; WARRANTS AND REPRESENTS THAT HIS/HER SUBMISSION; (a) IS ORIGINAL TO THE ENTRANT AND HAVE BEEN LEGALLY OBTAINED AND CREATED, (b) DOES NOT INFRINGE THE INTELLECTUAL PROPERTY, PRIVACY OR PUBLICITY RIGHTS OR ANY OTHER LEGAL OR MORAL RIGHTS OF ANY THIRD PARTY, OR VIOLATE APPLICABLE LAWS, REGULATIONS, OR NETWORD STANDARDS; (c) HAS NOT BEEN ENTERED IN OR WON PREVIOUS CONTESTS OR AWARDS; AND (d) HAS NOT BEEN PUBLISHED PREVIOUSLY IN ANY MEDIUM; Irrevocably grants to Organizer and its affiliates, legal representatives, assigns, agents and licensees, the unconditional and perpetual right and permission to copyright (as appropriate), reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, exhibit and/or otherwise use or reuse (without limitation as to when or to the number of times used), the Entrant’s name(s), image, voice(s), likeness, statements, biographical material and Submission, including, but not limited to, the video or digital recording performances contained in any of the above items (in each case, as submitted or as edited/modified in any way by the Organizer, in the Organizer’s sole discretion), as well as any additional photographic images, video images, portraits, interviews or other materials relating to the Entrant and arising out of his/her participation in this contest (with or without using the Entrants name) (collectively, the “Additional Materials”) in any media throughout the world for any purpose, without limitation, and without additional review, compensation (except if required by law), or approval from the Entrant or any other party; Forever waives any rights of privacy, intellectual property rights, and any other legal or moral rights that may preclude the Organizer’s use of the Entrant’s Submission or Additional Materials, or require the Entrant’s permission for Organizer to use them for any purpose, and agrees to never sue or assert any claim against the Organizer’s use of those Materials; Agrees to indemnify and hold the Organizer and its respective affiliates, officers, directors, agents, co-branders or other partners, and its employees (collectively, the “Promotion Indemnities”), harmless from any and all claims, damages, expenses, costs (including reasonable attorney’s fees) and liabilities (including settlements), brought or asserted by any third party against any of the Promotion Indemnities due to or arising out of the Entrant’s Submissions or Additional Materials in this promotion, or the Entrant’s conduct during and in connection with this Promotion, including but not limited to trademark, copyright, or other intellectual property rights, right of publicity, right of privacy or defamation; Agrees to release, indemnify and hold harmless Organizer from any and all claims that any commercial, advertising, presentation, web content or any other material subsequently produced, presented, and/or prepared by or on behalf of Organizer or the Organizer infringes on the rights of the Entrant’s work as contained in any Submission.

10. General Conditions: If for any reason the contest is not capable of running as planned, including, but not limited to, the cancellation or postponement of the Ukulele Safari Australia or the Melbourne Ukulele Festival, because of fraud, virus, or other technical problems, the Organizer may, in its sole discretion, may cancel modify or terminate the Contest. The Organizer reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the operation of the Contest or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, the Organizer reserves the right to seek damages from any such person to the fullest extent permitted by law. Failure to enforce any terms of these Official Rules shall not constitute a waiver of that or any other provision. In the event of a dispute as to any registration, the authorized account holder of the e-mail address used to enter will be deemed to be the participant. The “authorized account holder” is the natural person, who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address.

11. Releases and Limitations of Liability: Except where prohibited by law, by registering and/or participating in the Contest, the respondent agrees to release and hold harmless the Organizer, its related companies, and its respective officers, directors, employees, and agents (collectively, the “Released Parties”) from and against any claim or cause of action arising out of the preparation for or actual participation in the Contest or receipt or use of the prize, including, but not limited to: (a) unauthorized human intervention in the Contest; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Contest; (f) loss or damage to Submissions; or (g) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from participant’s preparation for or participation in the Contest or receipt or use of the prize. Except where prohibited, the participant agrees that (a) any and all claims, judgments, and awards allowed under the Official Rules shall be limited to out-of-pocket costs incurred, including costs associated with participation in the Contest but in no event attorneys’ fees; and (b) under no circumstances will the participant be permitted to obtain awards for, and the participant hereby waives all rights to claim, punitive, incidental and consequential damages and any other damages, and any and all rights to have damages multiplied or otherwise increased. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above may not apply to you.

12. Disputes: Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prize awarded, other than those concerning the administration of the Contest or the determination of winners, shall be resolved individually, without resort to any form of class action; (ii) any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, shall be resolved by the Cairns Magistrates’ Court; (iii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, but in no event attorneys’ fees; and (iv) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Organizer in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Queensland or, where applicable, the Commonwealth of Australia.

15. Reservation of Rights: The Organizer reserves the right, at his sole discretion, to cancel, terminate, modify, suspend or postpone this contest and/or these Official Rules. This contest is void where prohibited by law. All federal, state and local laws and regulations apply. No transfer or substitution of prize will be permitted.
